In August, the first of what may be many awards related to vaginal mesh implants was handed down by a jury in Charleston, West Virginia. After twelve hours of deliberations, the manufacturer, C.R. Bard Inc., was held responsible for injuries one woman suffered from its Avaulta line of vaginal devices. The jury award totaled $2 million, with $250,000 in compensatory damages and $1.75 million in punitive damages.
In finding for the plaintiff, jurors concluded that the manufacturer had not adequately warned the public about dangerous flaws in the design of its vaginal mesh implants. The jury also concluded that the company’s actions rose to the level of “malice, fraud or wantonness” and awarded punitive damages to deter similar harmful actions in the future. C.R. Bard is just one of many mesh manufactures facing claims related to defective vaginal products.
The injuries caused by vaginal mesh products have been severe and life changing. Many women have required numerous corrective surgeries to repair the internal damage caused by these harmful devices. Unfortunately, for too many women, the injuries cannot be reversed, leaving them with permanent pain and suffering.
